SparkNamer Terms of Service

You must be legally able to enter into these Terms. If you use SparkNamer for a company or other organization, you represent that you have authority to bind that organization.

You are responsible for accurate account information, safeguarding your credentials, and all activity under your account. Notify us promptly if you suspect unauthorized access. You may not share access in a way that bypasses plan limits or account controls.

SparkNamer provides domain research, automated appraisal, monitoring, evidence organization, workflow, and related tools. Features, data sources, limits, and availability may change as the service develops.

Domain values, rankings, comparable sales, availability checks, buyer signals, monitoring results, and other outputs are automated estimates or informational research. They may be incomplete, delayed, unavailable, or incorrect. SparkNamer does not guarantee a sale price, buyer, registration outcome, legal clearance, availability, or investment result.

SparkNamer content is not financial, investment, legal, or tax advice. You remain responsible for independent verification and for decisions involving purchases, registrations, bidding, sales, trademarks, taxes, contracts, or third parties.

Paid features require an active subscription. Prices, included usage, billing intervals, and material purchase terms are shown before checkout. Lemon Squeezy acts as the payment processor and merchant of record where stated at checkout.

Unless the checkout expressly states otherwise, subscriptions renew automatically at the displayed billing interval until canceled. You authorize the applicable recurring charges when you complete checkout. You can cancel through the available billing controls or by contacting support; cancellation normally takes effect at the end of the current paid period unless applicable law or the checkout terms require otherwise.

Unless expressly offered at checkout, SparkNamer plans do not include a free trial. Refunds, taxes, currency conversion, and payment disputes are handled according to the checkout terms, Lemon Squeezy's applicable policies, and applicable law.

You may not use SparkNamer to:

• Violate law, intellectual-property rights, privacy rights, or contractual obligations.
• Probe, disrupt, overload, reverse engineer, or bypass security, authentication, subscriptions, quotas, or technical restrictions.
• Use automated access except through interfaces or integrations expressly authorized by SparkNamer.
• Submit malware, deceptive content, unlawful personal data, credentials, payment-card information, or confidential information you are not authorized to process.
• Resell, sublicense, or commercially exploit the service or its data unless we agree in writing.

You retain your rights in domain lists, notes, and other content you submit. You grant SparkNamer a limited license to host, process, reproduce, and transmit that content only as reasonably necessary to operate, secure, and improve the service and comply with law.

If you provide suggestions or feedback, you allow SparkNamer to use it without restriction or compensation, provided we do not publicly identify you without permission.

SparkNamer and its software, design, branding, and original content are protected by applicable intellectual-property laws. Except for the limited right to use the service under these Terms, no rights are transferred to you.

The service may rely on or link to third-party providers, data sources, websites, registrars, marketplaces, authentication services, and payment services. Their products and terms are controlled by those third parties. SparkNamer is not responsible for third-party services or for changes, interruptions, or inaccuracies originating from them.

We may restrict or suspend access when reasonably necessary to protect the service or users, investigate suspected abuse, comply with law, address nonpayment, or enforce these Terms. We may terminate accounts for material or repeated violations. You may stop using SparkNamer at any time; subscription cancellation is governed by the billing section above.

To the maximum extent permitted by law, SparkNamer is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not warrant uninterrupted operation or that every result is accurate, current, complete, or suitable for your intended use.

To the maximum extent permitted by law, SparkNamer and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or domain transactions. Our aggregate liability relating to the service will not exceed the amount you paid to SparkNamer for the service during the six months before the event giving rise to the claim. These limits do not apply where prohibited by law.

We may update these Terms as the service changes. We will post the updated version and revise the “Last updated” date. Material changes may also be communicated through the service or by email. Continued use after the effective date constitutes acceptance where permitted by law.

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, financing, merger, acquisition, or sale of the service. Applicable law governs these Terms without overriding consumer protections that cannot legally be waived.
